Users utilise this system for their own particular purposes at their own risk. ***************************************************************************** R U L E S A N D R E G U L A T I O N S Terms V1.13 2/6/03, V1.2 9/8/20 The following are the main rules, regulations and conditions of this service. * All prices and charges referred to exclude Goods and Services Tax, GST. 10% GST is applicable and will be charged to the total of all bills. * Cost of subscription is $ 50 +gst per Year. * Email diversion to any email address can be arranged for free. There are no volume fees provided that volume is not exessive in our opinion. If the email address being diverted to is unreliable or rejects any email from our service we may remove diversion if we deem appropriate, without refund. So please ensure the receiving email address is continuously reliable. * No refund for partially unused subscription. Any unused annual subscription not used within the 1 year period is not refundable if the account is closed for any reason. * You should provide 1-2 months notification in writing if you wish to close your account. 2 months at the MOST. Do NOT provide longer notification such as 3-12 months as we will not keep track or accept responsibility over two months for your request. You are of course liable for all bills including but not limited to usage and also any due Subscription up to the time that the account is actually closed. It is MOST important that you make SURE you ask for WRITTEN confirmation that we have ACKNOWLEDGED receipt of your request to close your account and CONFIRMED that we will do so accordingly. In particular, we will NOT provide any Credit Card debited refund for any closure request received AFTER the due resubscription date. To avoid any possible dispute we recommend you keep our written ACKNOWLEDGEMENT for future reference. Unsubstantiated disputes waste everyone's time and will be charged our usual hourly rates for us to handle. * If you do not want your credit card to be debited for resubscription as and when your subscription falls due it is ABSOLUTELY VITAL that you advise so in WRI BEFORE the subscription payment falls due or the debit has been done. We do NOT do refunds under any circumstances including but not limited to cases where users fail to explicitly advise us to remove their car details or fail to explicitly in writing cancel and close their account. We will be more than happy to provide ACKNOWLEGEMENT IN WRITING which you should retain for future reference to avoid any arguments or disputes regarding substantiation of account closure requests. * It is the customer's responsibility to treat their internet account seriously. Please ensure you keep adequate funds and advise us advise us of new expiry dates or changes to save time. * Billing is normally done by users receiving E-Mail Invoices which they should, but are not required, to print. Payment can be sent without hard copy of the E-Mail invoice. But hard copy is preferred. At the very least please include the invoice reference number or remittance advice portion with your payment to make it easier for us to work out who is paying it and what the payment is for (Don't laugh ! But a lot of cheques we receive don't have ANY information at all with them !). Reissuing and backtracking of invoice and billing information is chargeable at our normal hourly service rates (minimum of $36). * Payment can be made in person, by postal cheque, bank deposit or Visa or Mastercard credit cards (add 3% for credit cards). Customers can provide credit card details for automatic billing for convenience. Credit card authorisation for any one payment on any and all goods and services that we provide is also deemed to be authorisation for future payments, automatically, as they fall due or become overdue, on any or all of the customer's due debts, not just those related to the internet service but including internet access services, purchase of goods and provision of labour services. We reserve the right to debit one or several credit cards provided to us from time to time if one card has insufficient funds and is declined, to meet all debts in full. * Payment from the date of the E-Mail invoice is required within 7 days. Non payment, declined credit card or bounced cheques can result in automatic access blockage to the system (nothing personal). So please do avoid late payments and bouncy cards and cheques ! It wastes a LOT of time and creates as much hassle and additional manual handling for us as what it causes bad feelings from you. Late payment or insufficient cheque or cards funds can cause embarrassment for both of us and hinders rather than benefits smooth running and enjoyment of the service. Keep in mind that the service aims to run at a VERY low profit margin and therefore necessitates minimal manual handling on our part to keep costs down. * Accounts which become blocked for non payment or late payment or declined credit cards or bounced cheque etc. will attract an Unblocking/Reconnection fee of $35. This fee is to help cover the labour time cost in handling overdue account and is to encourage prompt payment with minimum manual intervention on our part. * Subscription to this service does not include the cost of any necessary software to access or make use of it, such as terminal software, Windows socket software, Internet browsers such as Firefox etc. It is up to the user to obtain it if required. Most popular operating systems usually come with the necessary software and therefore don't need those often troublesome software starter kits. We have "hint sheets" which we are happy to provide to help you configure your system. Phone us for details if required. * Subscription to this service does not include provision of any hardware necessary to use the system. The subscriber is responsible for providing their own terminal equipment and communications link and for ensuring system compatibility of both their hardware and software. * Some Shareware and Public Domain utilities, application programs and other files may be available on this system for users to download. These utilities often have different licensing and payment conditions and requirements depending on the personal circumstances of individual users. It is up to the user to meet their lawful requirements to prevent infringement of copyrights to those licensing requirements associated with the various downloaded files. It is essential that you read and comply with any terms and conditions which may be associated with any downloaded files. * We do not take responsibility for the suitability or performance for any purpose of this service or any files downloaded from this service. * Subscription to this service does not include support either personally or by telephone in the event that users have problems accessing or using this service for any reason whatsoever. Some users will find it easy to use this service, some may not. Depending on your level of expertise. We find virtually all users problems are problems at their end. Not our's. Users who have any kind of problems or difficulties requiring assistance should therefore make arrangements to meet their individual support requirements depending on their level of technical expertise. We feel it would be unfair to charge users who don't need a lot of assistance to make up for those that do. As always, if you have any problems using this service we will be happy to provide assistance at our usual service rates. It's what keeps us going. Users are welcome to avail themselves of this service to get their systems configured, any necessary tutorials, consultation, advice, demonstration etc. to get their systems up and running on this service as required by individual circumstances. But please do NOT expect or demand free help and consultation to get your problems solved. * Subscribers will be issued with an identification name to allow access to this service. The subscriber is liable for any and all charges attributable to that identification name. * Users who operate a home page are specifically prohibited from using any copyrighted material. We will not be held responsible for material displayed on the system by users. We reserve the right to remove home page material without notice if such material is in our opinion suspected of being copyrighted, illicit, M R or X rated, anti Christian, contravertial or not in line with the ongoing standard of our service or possibly offensive to some segments of the community. Our judgement will be deemed final in this regard. Keep in mind that this is a Christian based system which may not suit all users. So keep it legal and keep it clean and all will benefit and be happy. * Users who operate a home page are specifically prohibited from using it to promote other advertising mediums such as Link Exchange. Which can cause other services on the internet to advertise themselves on OUR system. Users are reminded that their free home page facility should not cause more than a reasonable amount of traffic. All users end up paying for it through increased bandwidth cost incurred by us. Homepages which attract hundreds of hits per day may be charged commercial volume and traffic rates. So please don't waste our bandwidth resources by causing traffic just for the sake of it or just to get hits. * The use of this service including but not solely the storage of information or access to or use of information is at the subscriber's own risk. Micronica and its employees, agents, information providers, other clients, and licensors will not be responsible for any damage or loss suffered or incurred by any subscriber or other person or corporation arising in any way whatsoever form the presence or lack of information or the service. * Neither Micronica nor its employess, owners, information providers or agents give any warranty of any kind either express or implied as to the merchantability or fitness of this service for a particular purpose, or that the service will be error free, or that the results or performance from the service or use of the service will be of a particular quality. * We can not and do not accept any responsibility for the provision or performance of communications links into or out of our service equipment. * The subscriber assumes sole responsibility for all use of the service or information supplied and agrees to release Micronica its agents, employess, owners, licensors and information providers from and indemnify them against any liability whatsoever or claim by any person arisiong from the information supplied or any infringement of copyright or breach of any restrictions applicable to the use of such information. * The subscriber's identification login name and also their password is important. You bear the risk of fraudulent use by someone who knows your login name and password which they may have obtained from you or any illegal means. The subscriber hereby indemnifies and shall keep indemnified Micronica, its employees, owners, agents, licensors or information providers in repect to any loss or damage action claim suit or proceeding against them by any person or corporation with respect to the use of the service by means of the customer's access identification name and/or password. Including but not only the transmission or any illegal or fraudulent material transmitted by the customer or caused to be transmitted through this service. * Subscribers may not sell, transfer or assign this service or agreement without prior written consent from Micronica. * Micronica may terminate this agreement at any time without notice. Particularly where we feel the service has been misused or abused by the subscriber. Such judgement being at the sole discretion of Micronica. We insist that users of the system conduct themselves in a responsible and respectful manner. * We may vary the terms and conditions at any time but will provide at least seven days notice before taking effect. Changes relating to the availability and content and any publisher's conditions may be made without notice. You can obtain the current latest terms and conditions from our web site or by request. * The customer's Email access may be interrupted by equipment failure, the need for routine maintenance, peak demand and so on from time to time. We will not compensate users in any way for such interruptions. But we do try our best to keep disruptions to a minimum. * The customer must not deliberately or carelessly do anything which could damage our equipment, software, setup or services. * The customer must not use their Email access to annoy, harass, threaten or harm anyone and must not use their Internet access for any unlawful purpose or in any unlawful manner. * The customer shall not use the service for spamming, junk mail, bulk sending or posting of unsolicited messages, or any use of distribution lists that include people who have not given specific permission to be included in such distribution process. * The customer shall at all times provide us with accurate information. * The customer shall not attempt to interfere in anyway with our networks or network security, or attempt to use the service to gain unauthorized access to any other computer system. * The customer will keep safe and confidential all and any access numbers, codes or passwords related to our system. * Unthinking or careless users can disrupt a system to the detriment of all other users. We reserve the right to block your account and delete without notice any material on our system which in our opinion is unauthorised, unlawful, obscene, excessive in volume, uncollected for an excessive period, in an unauthorised place or dangerous, or deemed unfit without giving any reason or incurring any liability for doing so. Specially if it is disruptive or potentially disruptive to the system or other users. The customer may incur labour, data volume and service charges if such action is taken, at our prevailing rates. * The customer shall, in particular, ensure that they read and clear their email on our system regularly to ensure that it does not build up to very large volumes. A typical guide being a maximum of 10 MB for no more than one week. Some users have caused problems by allowing unread email to accumulate to very large volumes for long periods. Any stored up email which is not cleared within 7 days of us requesting you to do so may be deleted by us without further notice. * We may give notices about any matter related to your account by fax, email, telephone, telephone message to person or answering service, or post at the last fax number, phone number, email or postal address registered in our system at the time. It is up to you to keep your contact details up to date. ===//===
